312-49v10 Exam - Question 103

Jason has set up a honeypot environment by creating a DMZ that has no physical or logical access to his production network. In this honeypot, he has placed a server running Windows Active Directory. He has also placed a Web server in the DMZ that services a number of web pages that offer visitors a chance to download sensitive information by clicking on a button. A week later, Jason finds in his network logs how an intruder accessed the honeypot and downloaded sensitive information. Jason uses the logs to try and prosecute the intruder for stealing sensitive corporate information. Why will this not be viable?

Show Answer
Correct Answer: A

Jason's attempts to prosecute the intruder are not viable due to entrapment. Entrapment occurs when someone is induced or persuaded to commit a crime they had no original intention of committing. By setting up a honeypot that offers sensitive information for download, Jason has effectively created a scenario where the intruder is lured into committing a crime, which can be a solid legal defense for the intruder.

Entrapment (Illegal and unethical): When someone is persuaded to commit a crime they had no intention to commit and is then charged with it. Openly advertising sensitive data and then charging people when they access them. Entrapment is a solid legal defense. Enticement (Legal and ethical): Making committing a crime more enticing, but the person has already broken the law or at least has decided to do so. Honeypots can be a good way to use Enticement. Have open ports or services on a server that can be attacked. Enticement is not a valid defense.
